By accessing and using RACEprompt, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. Dr. Jonesy's AI Lab reserves the right to make changes to these terms at any time. Your continued use of this site following the posting of revised terms means that you accept and agree to the changes.

2. Account Terms

When you create an account on RACEprompt, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your password and account. You agree to accept responsibility for all activities that occur under your account.

You may not:

• Use RACEprompt for any illegal purpose or in violation of any laws
• Share your account credentials with others
• Impersonate another person or entity
• Harass, threaten, or abuse other users
• Attempt to gain unauthorized access to the service

3. Subscription & Billing Terms

Free Tier

The Free tier provides access to basic features at no cost. We reserve the right to modify or discontinue the free tier at any time with notice.

Paid Subscriptions (Pro / Annual)

• Billing occurs automatically on your selected schedule (monthly or annually)
• You authorize us to charge your payment method on file
• All charges are non-refundable except as required by law
• Subscriptions renew automatically unless you cancel before the next billing date
• Price changes will be notified 30 days in advance

14-Day Reverse Trial

We offer a 14-day money-back guarantee on all paid subscriptions. If you are not satisfied with RACEprompt, contact us within 14 days of purchase for a full refund.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation becomes effective at the end of your current billing cycle. No refunds are issued for partial months or unused portions.

4. BYOK (Bring Your Own Key) Terms

When using your own API keys:

• You are responsible for managing and securing your API keys
• RACEprompt is not responsible for unauthorized access to your keys
• You are solely responsible for charges incurred through your API keys
• You agree to comply with the terms of service of the AI provider (Anthropic, OpenAI, Google)
• RACEprompt does not guarantee uptime or reliability of third-party AI services

5. AI-Generated Content Disclaimer

RACEprompt enables you to generate content using third-party AI models. You acknowledge that:

• AI-generated content may not be accurate, complete, or appropriate for all purposes
• You are solely responsible for reviewing, editing, and verifying AI-generated content
• AI models may produce biased, harmful, or offensive content
• You assume all liability for how you use AI-generated content
• You may not use AI-generated content to violate others' rights or create fraudulent materials

6. Intellectual Property Rights

Our Content

All content provided in RACEprompt, including prompt templates, original documentation, app design elements, and the RACEprompt app implementation, are owned by Dr. Jonesy's AI Lab and protected by copyright and intellectual property laws.

Your Content

You retain ownership of any prompts and content you create in RACEprompt. However, you grant us a license to use your content to:

• Store and display your content in your account
• Process your content through AI models
• Improve RACEprompt services (in anonymized form)
• Comply with legal obligations

Third-Party Content

Content generated by third-party AI services is subject to those providers' terms of use and intellectual property policies.

7. Limitation of Liability

• We are not liable for indirect, incidental, special, or consequential damages
• We are not liable for data loss, business interruption, or lost profits
• Our total liability shall not exceed the amount you paid in the last 12 months
• We are not responsible for third-party AI service availability or accuracy

8. Termination

We may terminate your account immediately without notice if:

• You violate these terms of use
• You engage in illegal activities
• You violate third-party rights or laws
• Your account payment fails or is fraudulent
• We determine you pose a risk to our service or other users

Upon termination, your access to RACEprompt ceases immediately. We may delete your account and data in accordance with our Privacy Policy.

9. Governing Law

These terms are governed by and construed in accordance with the laws of the United States, and you irrevocably submit to the exclusive jurisdiction of the courts located in the United States for the resolution of any disputes.

10. Modifications to Service

RACEprompt reserves the right to modify, suspend, or discontinue the service at any time with or without notice. We are not liable to you or any third party for any modifications, price changes, suspension, or discontinuation of the service.

11. User Conduct

You agree not to use RACEprompt to:

• Create content that violates laws or third-party rights
• Generate fraudulent, deceptive, or misleading content
• Create content for phishing, spam, or harassment
• Create content intended to deceive or manipulate
• Generate malicious code or content
• Scrape data or attempt to extract proprietary information
